Orioon/Groooovy has an interesting scenario where a known RMT handed him a large sum of gil and expensive items the same day he got banned. That's the only time there is confusion: where an RMT gives items to somebody that could be their friend, it's less clear, but regardless, those items should be taken away. Nas saw fit to jail Orioon and did another investigation after his initial one. That's not a typical scenario.
You're right, this is an assumption going off of the mass bannings of RMT stuff, twitter post and the lack of communication from Nas.
Assuming is shitty I know, but waiting around 3 days is shitty too, especially if the character is going to be loss of character. Please understand my frustration, going from having a lot of fun with my friends then a friend gets put into jail, no word from Nas for 3 days. So she is in Limbo waiting for what? Lets have some closure, I would think the investigations happen prior to being put in jail.
