Given the full 20 minutes of video, I could probably give a strong indication whether it is nasomi server or not. Given the time, time zone, and date, Nasomi could probably verify some things from his logs. The clip of the video as it stands could feasibly be another private server.

The video of Mijin using chainspell doesn't prove anything beyond all reasonable doubt either. Given the amount of time left in the window they had a ~1% chance of timing their chainspell correctly by chance.

If I were a gambling man I'd say they're probably both guilty; however I don't think the public evidence as it currently stands is substantial enough to ban either of them. That's just my opinion.

as for why someone would do that: that is definitely how I would do it. Nas has ways to detect speed hacking, and POS hacking. if I was going to do it, I'd make sure I moved the smallest difference possible.
