AFK'ing where a mob pops that can aggro and kill you and no one doing anything to stop it =/= AFK'ing in the same zone as a mob that can aggro and kill you, and someone pulling that mob over to you and then hiding so that it kills you

I can't assume what he was doing, all I know he was afk in the spawn area. Usually, when people are doing that, they want a TOD. If not, they are stupid, because they are risking their character dying for absolutely no reason, especially in an area like sky where there are plenty of safe spaces to afk.

Once again, you are implying that I trained Despot this great distance to "MPK Chess." What are you describing is definitely MPK, because they are purposefully dragging an NM out of its spawn area to kill someone. I was trying to survive. I was within Despot's spawn area, and so was Chess. Could I have done other things to survive? Maybe, I don't remember the exact situation. 2boxing with adds in a magic-aggro zone gets tricky fast.

That's not the same, an aggressive monster periodically spawns in LoO and you AFK there in hope that someone else kills it. No action required to make that a dangerous AFK spot.

He had to perform actions to spawn Despot, meaning he is responsible for it killing another player.
